Constitutionalism in Latin America: indigenous justice and legal pluralism in Ecuador

Abstract

The society confronts new challenges and perspectives related with the complexity and diversity of the multicultural context, in which it is inserted in the current times, which demands the perfection of the social and cultural link to solve the actual problems of the indigenous people, like recognition of their principles of Justice into the juridical pluralism. In a multicultural society, like the Ecuador, it is required to embrace new focuses that solve the referred problems. The present document aims to establish some doctrinaire principles in order to harmonize the ordinary courts and the indigenous justice. This analysis is elaborated from the need to offer alternatives of juridical formation delimited in a social pedagogy that allows to educate for the defense of the principles of Justice and the respect of the indigenous people culture, the document discusses the juridical categories and it argues in favor of establish a juridical order for develop superior levels of social opportunities for the citizens.

La sociedad contemporánea enfrenta nuevos retos y perspectivas en correspondencia con la complejidad y diversidad del contexto multicultural, lo cual exige el perfeccionamiento del vínculo social y cultural para solucionar problemáticas actuales de los pueblos indígenas, como el reconocimiento de sus principios de justicia frente al pluralismo jurídico. En una sociedad multicultural, como es el caso del Ecuador, se requiere adoptar nuevos enfoques que solucionen la referida problemática. Desde esta consideración, el presente trabajo tiene como objetivo establecer principios doctrinarios sobre los cuales debe sustentarse la armonización en la justicia ordinaria y la justicia indígena. Este análisis se elabora a partir de la necesidad de brindar alternativas de formación jurídica enmarcadas en una pedagogía social que permita educar para la defensa de los principios de justicia y respeto cultural a los pueblos indígenas; se abordan categorías jurídicas y se resignifica la necesidad de establecer un orden jurídico en la sociedad que contribuya a alcanzar niveles superiores de oportunidades sociales para los ciudadanos.
