All Saints' Protestant Episcopal Church has lost a round in federal court in a dispute over an insurance claim. The church's insurer, a New York company called The Church Insurance Co., refused to pay for water damage that resulted from roof problems.
All Saints', which was founded in 1874, has buildings at 2831 Kingshighway and around the corner at 5010 Terry Avenue. According to court papers, they had been insured by Church Insurance for more than 40 years.
In 1992, the buildings suffered severe water damage. All Saints' filed a claim in March 1993.
In May and June 1993, an adjuster for Church Insurance and a parishioner discussed the damages and came up with widely varying estimates of repair costs. The adjuster made an oral offer then of $20,000 and that was rejected, the rector of All Saints', Rev. Emery Washington Sr., said in an affidavit.
In March 1994, an engineer hired by Church Insurance inspected the buildings and reported that all the water damage resulted from lack of maintenance by All Saints' personnel.
